These Terms and Conditions (“Terms”) govern your access to and use of the LinkApp mobile application, website, and related services (collectively, the “Platform”).

These Terms and Conditions (“Terms”) govern your access to and use of the LinkApp mobile application, website, and related services (collectively, the “Platform”).

1) Acceptance of These Terms

By accessing or using the Platform, you agree to these Terms. If you do not agree, you must not access or use the Platform. You also agree that you have read and understood these Terms.

If you use the Platform on behalf of an organization, you represent and warrant that you have authority to bind that organization, and “you” includes that organization.

2) Definitions

  • “Platform” means the LinkApp app, website, and related services, features, and tools.
  • “User” means any person who accesses or uses the Platform.
  • “Customer” means a User who requests, searches for, books, or pays for services, opportunities, or interactions on the Platform.
  • “Service Provider” means a User who lists, offers, provides, or delivers services, opportunities, or work through the Platform.
  • “User Content” means content you submit or make available on the Platform (including profile info, listings, requests, photos, videos, messages, reviews, and ratings).
  • “Transaction” means a payment or attempted payment made through the Platform.

3) Eligibility and Worldwide Use

3.1 Age Requirement

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Platform. By using the Platform, you represent and warrant that you meet this requirement.

3.2 Worldwide Availability; Local Law Compliance

LinkApp is intended to be available worldwide, but availability and features may vary by location. You are responsible for complying with all laws, rules, and regulations that apply to you in your location, including any rules related to online conduct, content, payments, consumer rights, and service delivery.

You may not use the Platform where it is prohibited by law. We may restrict access in certain regions to comply with legal requirements.

4) Accounts and Security

4.1 Account Registration

You may need an account to use certain features (such as messaging, saving items, creating listings, or making payments). You agree to provide accurate, current, and complete information and to keep it updated.

4.2 Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your account has been compromised, contact us promptly at onelink254@gmail.com.

4.3 One Person, One Account (if applicable)

We may limit or restrict multiple accounts per person where needed to prevent fraud, abuse, or impersonation.

5) Platform Overview and Our Role

5.1 What LinkApp Provides

LinkApp is a platform that helps people connect for love, work, and opportunities, including discovering and communicating with other users and (where available) requesting or offering services.

5.2 Marketplace / Platform-Only Role

Unless explicitly stated otherwise in writing, LinkApp is a platform provider only. We do not provide the services listed or offered by Service Providers, and we do not control, supervise, direct, or guarantee any Service Provider’s work, conduct, pricing, or outcomes.

Any agreement or arrangement between a Customer and a Service Provider is solely between those users. Service Providers are independently responsible for: (a) the services they offer; (b) accuracy of listings; (c) setting and honoring terms; and (d) complying with applicable laws.

5.3 Licenses, Insurance, and Verification

Service Providers are not required to provide proof of licensing, certification, or insurance on LinkApp. However, Service Providers are responsible for obtaining and maintaining any licenses, permits, approvals, or insurance required by law for the services they provide. Customers are encouraged to independently verify suitability, experience, and credentials where appropriate.

6) User Content, Reviews, and Permissions

6.1 Your Responsibility for User Content

You are solely responsible for your User Content and any consequences of posting or sharing it. You represent and warrant that you have all rights needed to submit the User Content and that it does not violate any law or any third-party rights.

6.2 License You Grant to LinkApp

You retain ownership of your User Content. However, by submitting User Content, you grant LinkApp a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting and display), distribute, publicly display, and perform your User Content for the purpose of operating, improving, promoting, and providing the Platform.

This license ends when you delete the relevant User Content, except to the extent we need to retain it for backups, legal compliance, dispute resolution, fraud prevention, or legitimate business purposes.

6.3 Reviews and Ratings

If the Platform offers reviews/ratings, you agree that your reviews will be honest, relevant, and not abusive, discriminatory, or misleading. We may remove reviews that violate these Terms or applicable law.

6.4 Feedback

If you provide suggestions, ideas, or feedback, you agree we may use them without restriction and without compensation to you.

7) Payments, Fees, and Refunds

7.1 In-App Payments and Payment Processors

The Platform supports in-app payments for certain features, services, or transactions (where available). Payments may be processed by third-party payment processors (for example, Paystack and/or other processors) (“Payment Processors”). Your use of a Payment Processor may be subject to that processor’s terms and policies.

7.2 Prices, Fees, and Taxes

Prices and any applicable fees will be shown to you before you complete a Transaction. You are responsible for any taxes, duties, or charges that apply to your purchases or earnings, as required by law. Service Providers are responsible for reporting and paying taxes on their earnings unless applicable law states otherwise.

7.3 Refund Policy (7 Days)

Refund processing timeframe: If a refund is approved, we aim for the refund to be reflected to your original payment method within 7 days. Your bank or payment provider may take additional time to post the refund.

Refund eligibility: Refunds are not guaranteed and may depend on the type of purchase, whether value has already been used or delivered, fraud or abuse checks, Payment Processor rules, and legal requirements. Some purchases (including completed services or consumed digital benefits) may be non-refundable where permitted by law.

How to request a refund: Email onelink254@gmail.com with your account identifier, transaction reference, date, amount, and reason. We may request additional information to investigate and process your request.

App store purchases: If you paid through Apple App Store or Google Play (where applicable), refunds may be handled by the relevant store under its policies.

7.4 Chargebacks and Fraud

We may suspend or restrict accounts involved in suspected fraud, unauthorized payments, or excessive chargebacks. You agree not to make a chargeback request for a valid transaction without first contacting support to attempt resolution.

8) Communications and Notifications

You consent to receive communications from us electronically, such as emails, in-app messages, push notifications, or SMS (where enabled and permitted). These communications may include account notices, security alerts, transactional messages, and service updates.

You may be able to opt out of certain promotional messages, but you may still receive important transactional or legal notices.

9) Prohibited Conduct

You agree not to do any of the following:

  • Use the Platform for unlawful, harmful, fraudulent, or deceptive purposes.
  • Harass, threaten, stalk, defame, intimidate, or abuse any person.
  • Exploit, harm, or attempt to exploit or harm minors (including by seeking or sharing any child sexual abuse material). We will report suspected exploitation to relevant authorities.
  • Post or share content that is hateful, discriminatory, or promotes violence.
  • Impersonate another person or entity, or misrepresent your identity or affiliation.
  • Post misleading listings/requests, scam messages, phishing attempts, or spam.
  • Share or request sensitive personal information through the Platform (e.g., passwords, full payment card numbers, government ID numbers).
  • Upload malware or attempt to interfere with the security or operation of the Platform.
  • Scrape, crawl, reverse engineer, or access the Platform in a way intended to extract data or source code without our written permission (except where prohibited by law).
  • Bypass or attempt to bypass any access controls, restrictions, or moderation decisions.

10) Safety, Offline Meetings, and Risk

The Platform may facilitate communication and offline interactions between users. You understand that meeting people or allowing someone into your home/workplace carries inherent risks. You are responsible for taking reasonable precautions and using good judgment.

LinkApp does not guarantee user identity, intentions, qualifications, licensing, or safety. In an emergency, contact local emergency services immediately.

11) Intellectual Property

The Platform, including its software, design, trademarks, logos, and content (excluding User Content), is owned by or licensed to LinkApp and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for your personal or internal business use. You may not copy, modify, distribute, sell, lease, or create derivative works from the Platform unless you have our prior written permission.

12) Third-Party Services and App Stores

12.1 Third-Party Services

The Platform may rely on or integrate with third-party services (for example, payment processing, maps, analytics, messaging infrastructure, or identity tools). We are not responsible for third-party services and your use of them may be governed by their terms and privacy policies.

12.2 App Stores

If you download LinkApp from Apple App Store or Google Play, you acknowledge that these Terms are between you and LinkApp only, not Apple or Google. Apple and Google are not responsible for the Platform, support, refunds (except as required by their policies), or claims related to the Platform.

13) Privacy

14) Moderation and Enforcement

We may (but are not obligated to) monitor, review, remove, or restrict access to User Content or accounts if we believe there is a violation of these Terms, a risk to the Platform or users, suspected fraud, or to comply with legal obligations.

We may also take steps such as warnings, content removal, feature limitations, suspension, or termination.

15) Suspension and Termination

You may stop using the Platform at any time. We may suspend or terminate your access at any time for violating these Terms, creating risk or legal exposure, or for any lawful business reason.

Upon termination, your right to use the Platform stops immediately. Provisions that by their nature should survive will survive, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law and Disputes.

16) Disclaimers

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINKAPP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT USERS WILL BE TRUSTWORTHY, QUALIFIED, OR SAFE. WE DO NOT GUARANTEE OUTCOMES RELATED TO LOVE, WORK, OPPORTUNITIES, BOOKINGS, OR SERVICES ARRANGED THROUGH THE PLATFORM.

17) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINKAPP (INCLUDING ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE PLATFORM OR INTERACTIONS/TRANSACTIONS WITH OTHER USERS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINKAPP’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO LINKAPP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) USD $100 (OR EQUIVALENT).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

18) Indemnification

You agree to defend, indemnify, and hold harmless LinkApp and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms or any law; or (d) your interactions or disputes with other users.

19) Governing Law and Disputes

19.1 Governing Law

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict of laws principles.

19.2 Dispute Resolution and Venue

You agree that any dispute arising out of or related to these Terms or the Platform will be brought in the courts located in Nairobi, Kenya, unless applicable law provides otherwise.

19.3 Consumer Rights

If you are a consumer, you may have mandatory rights under the laws of your country of residence. Nothing in these Terms limits those rights where it is not permitted.

20) Miscellaneous

  • Changes to Terms: We may update these Terms from time to time. Continued use after updates means you accept the updated Terms.
  • Entire Agreement: These Terms and the Privacy Policy form the entire agreement between you and LinkApp regarding the Platform.
  • Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
  • No Waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
  • Language: If these Terms are translated, the English version controls to the extent permitted by law.
